Health Data Explicit Consent and Information Notice

Explains the independent explicit-consent choices for mood, health and activity data, personal pattern analysis, and AI-supported insight features in eMRI / Emotional MRI.

Overview

This notice explains the independent explicit-consent choices for mood records, health and activity data, personal pattern analysis, and AI-supported insights in the eMRI / Emotional MRI app.

Important: eMRI is not a medical device, healthcare provider, crisis service, or continuous monitoring service. It must not be used for diagnosis, treatment, disease prevention, or medical decision-making.

1. Your choice

The consents below are separate and are not preselected. You may allow only the features you want to use. Refusing or later withdrawing one consent does not automatically affect your other independent choices.

Option A allows manual mood and self-report records to be stored.

Option B allows eMRI to receive health and activity data that you also permit on your device.

Option C allows data covered by A and B to be evaluated together; it therefore cannot operate unless A and B are enabled.

Option D allows limited summaries created only from data sources you have separately enabled to be used for AI-supported analysis. Consent to C or D does not constitute consent to the other.

Refusing consent does not prevent account creation, but the feature dependent on that consent will be unavailable or operate in a limited form.

3. Data covered

  • Mood, mood intensity, stress, energy, calmness, and body-tension responses.
  • Answers from mood check-ins, evening summaries, and similar self-assessments.
  • Optional free-text notes.
  • Contexts, activities, and tags selected by you.
  • Heart rate, resting heart rate, and heart-rate variability (HRV).
  • Sleep duration and, where available, sleep stages.
  • Steps, exercise, active energy, and movement/activity data.
  • Record time, time of day, and day of week.
  • Personal baselines, trends, changes, concordance, and relationship indicators derived from these data.

4. A — Mood and self-report data

If you consent: Your mood, stress, energy, calmness, body tension, context, check-in answers, and any notes you choose to add may be processed to store your mood records, display your history and emotional map, create basic personal summaries and reports, and operate the related app features.

Writing a free-text note is optional. You should avoid entering another person's personal information, identity details, or unnecessary sensitive information.

If you do not consent: Manual mood records, mood history, and personal reports based on those records will be unavailable.

Consent statement shown in the app: “I explicitly consent to the processing of my mood and self-report data to store my records, show my history, and provide basic personal summaries.”

5. B — Apple Health / Health Connect data

If you consent: Health and activity data types that you separately select through your device permission screen may be transferred to eMRI and processed to provide the related app features.

eMRI cannot access data types you have not permitted on your device. You can manage health-data access by data type in your operating-system settings.

If you do not consent: You may continue using manual mood check-ins, but body-signal indicators, health-data-based features, and dependent functions will be unavailable or limited.

6. C — Linking mood and health data

If you consent: Your mood and context records under A may be evaluated together with health and activity data permitted under B to create personal baselines and changes over time, contemporaneous relationships between mood, context, and body signals, daily and weekly personal pattern indicators, and features such as Today's Highlights, Emotional Map, Insights, and weekly reports.

These indicators may show statistical association or temporal concordance; they do not establish causation, clinical diagnosis, or a medical conclusion. Sensor measurements may be missing, delayed, or inaccurate.

If you do not consent: Data separately permitted under A and B may still be used for their respective features, but analyses linking mood and health data will not be produced.

7. D — AI-supported personal analysis

If you consent: Limited and pseudonymised period summaries created only from the data sources you have separately enabled may be processed by OpenAI Ireland Limited to generate natural-language personal insights, explanations, or suggestions.

The AI summary is designed not to contain direct identifiers such as your name or email address. Pseudonymisation does not make the data anonymous. Free-text notes are not included in the AI summary.

AI-supported outputs are generated automatically and may be inaccurate, incomplete, or inappropriate; are not medical or psychological diagnosis, treatment, crisis assessment, or professional advice; are not used as the sole basis for decisions producing legal or similarly significant effects concerning you; and are not designed to reliably detect emergencies or provide continuous monitoring.

If you do not consent: Manual records, health connections, and basic rule- or statistics-based features may remain available where you have given the other necessary consents, but AI-generated personal text will not be provided.

Details about the AI provider, processing location, possible third-country transfers, safeguards, retention, and whether data are used for model training are provided in the Privacy and Data Protection Notice.

8. Recipients and transfers

Your data may be processed by authorised hosting, database, notification, security, and AI service providers only to the extent necessary to provide the features you select. Current recipients, purposes, data regions, and transfer mechanisms outside the EEA are identified in the Privacy and Data Protection Notice.

Personal and health data are not sold or used for targeted advertising.

9. Retention and deletion

Data processed under consent are retained for as long as necessary to provide the relevant feature or while your account remains open, according to the periods specified in the Privacy and Data Protection Notice.

Withdrawing consent is not the same as deleting data. You may separately request deletion of existing data through the in-app data or account deletion controls. Limited records required by law and security or backup records retained for defined periods may be excepted.
